Logistics Services (Vietnam to GCC)
These Terms of Service form a supplementary set of conditions to those identified here: General Primis Terms of Use
1. Scope of Services
The following services will be provided to the Company:
- First Mile Collection: Pickup of goods from the designated location provided by the Company.
- Origin Customs Export Screening and Clearance: Handling of export consolidation, security screening and customs formalities at the origin airport.
- Cross Border Transportation: Transportation of goods via air, sea, or road as requested.
- Destination Customs Clearance: Handling of customs formalities at the destination.
- Destination Last Mile Delivery: Delivery of goods to the final consignee.
- Returns Management: Handling undelivered parcels, including return to origin or alternative instructions provided by the Company with cost of returns to be borne by the Company.
2. Service Level Agreement (SLA)
2.1 Parcel Liability
- The standard liability per parcel is limited to US$100. Primis will reimburse the actual value of the parcel or the liability cap, whichever is lower.
- Additional coverage can be arranged at an extra premium or through third-party insurers.
2.2 Limits of Service
- Primis shall not be liable for delays caused by customs clearance, weather conditions, government related delays, or other unforeseen circumstances beyond its control.
2.3 Force Majeure
- In the event of force majeure (e.g., natural disasters, war, strikes, government closures), Primis reserves the right to amend or cancel services without liability.
2.4 Amendments and Additional Costs
- Any modifications to shipment details, including weight, dimensions, or destination, after booking may result in revised charges.
2.5 Packaging Responsibility
- The Company is responsible for ensuring proper packaging to prevent damage during transit.
- Shipments must adhere to restrictions by destination customs and IATA Dangerous Goods regulations.
2.6 Non-Delivery/Return Handling
- In case of non-delivery or consignee refusal, goods will either be:
- Returned to the Company at the Company’s expense, or
- Handled according to alternative arrangements, with additional costs applied.
2.7 Additional Surcharges
- Peak or demand surcharges, or other applicable fees may apply during peak seasons.
- The Company will be notified 30 days in advance of any additional surcharges prior to shipping.
3. PAYMENT TERMS
3.1 Payment Options
The Company agrees to the following payment terms:
- 14 Days from Invoice Date
4. SECURITY DEPOSIT
A refundable security deposit of USD $ 5,000 shall be applied based on the Company’s projected monthly shipping revenue. The deposit will be held as collateral against unpaid invoices or other liabilities and refunded upon termination of the Agreement, subject to outstanding dues.
5. LIABILITY AND INSURANCE
5.1 Limits of Liability
- Primis liability is limited to USD$100 per shipment due to loss or damage, unless additional insurance is purchased.
- Primis is not responsible for loss or damage resulting from:
- Improper packaging by the Company.
- Delays caused by customs, weather, or other uncontrollable events.
5.2 Optional Insurance
- The Company may opt for additional insurance coverage through Primis at an agreed premium.
Rates and Transit Times are as shared with the Company either within an Order Form or as part of a update to the rates (as applicable).
